These Terms of Service (“Terms”) govern your access to and use of the FitBudget mobile application, our website(s), and any related content, features, and services (together, the “Services”). “FitBudget,” “we,” or “us” refers to FitFinanceDad LLC, a Wyoming limited liability company.
By using the Services, or by clicking “I agree,” you accept these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1) Eligibility & Accounts
- Age. Not for children under 13. If under your local age of majority, you may use the Services only with a parent/guardian who accepts these Terms.
- No account required for basics. You can use manual budgeting without an account.
- Account for Pro features. To link financial accounts, enable syncing, or use premium features, create/sign in to an account. Keep credentials confidential and notify us of suspected unauthorized use.
2) What FitBudget Is (and Isn’t)
- Personal budgeting tool. Plan budgets (including ZBB), track expenses, set goals, and detect recurring payments.
- Not a financial institution or advisor. We don’t hold/transfer funds and don’t provide financial, investment, legal, or tax advice. Your decisions are your responsibility.
3) Privacy-First Design & Your Data
- Local-only by default. Your budgeting data is stored locally on your device in AES-encrypted storage. Optional PIN/biometric lock.
- When data can leave your device. If you link accounts, some requests go to our server to coordinate with Plaidand manage subscription entitlements. We do not receive or store bank login credentials. See our Privacy Policy for full details.
- Backups. If you export/back up data, you are responsible for protecting export files and any passphrases you set.
4) Third-Party Connections (Plaid) & Authorization
If you connect bank/credit accounts, you instruct us and Plaid Inc. (and affiliated Plaid entities regionally) to access and transmit account information from the institutions you choose solely to provide the Services. By using bank linking, you agree to Plaid’s End User Services Agreement and Plaid’s Privacy Policy. Third-party data may be delayed, incomplete, or inaccurate; we don’t control those systems.
UK/EEA. If you connect UK/EEA accounts, Plaid Financial Ltd. may provide regulated account-information services in that region, governed by their regional terms and privacy notices.
5) Subscription; Trials; Billing; Cancellation
- Plans. Manual budgeting features are free. Pro features are available on a subscription basis.
- Displayed pricing. Subscription pricing and currency are shown in-app at the time of purchase through the Apple App Store or Google Play, and may vary by region, applicable taxes, or promotions.
- In-app purchase. Purchases, renewals, cancellations, and refunds are handled directly by your platform provider (Apple App Store / Google Play).
- Auto-renewal. Subscriptions automatically renew until canceled. You can cancel at any time in your device’s subscription settings; cancellation takes effect at the end of the current billing period.
- Changes. We may update plan features and subscription offerings on a go-forward basis. If platform pricing increases, the platform will notify you as required by law, and you may cancel before the changes take effect.
- Refunds. Any refund requests must be submitted through the platform provider and are subject to their policies.
6) Accuracy, Availability & Recurring Detection
- Data accuracy. We rely on third-party systems (your institution, Plaid). We can’t guarantee timeliness or accuracy of fetched data.
- Recurring detection. Uses heuristics and third-party signals; may misclassify or miss items—please review.
- Service interruptions. The Services may be unavailable or delayed due to maintenance, outages, or provider issues.
7) License & Acceptable Use
- License. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Services for personal, non-commercial purposes.
- Prohibited conduct. You agree not to: resell or reverse engineer; violate laws; infringe rights; bypass security; upload malware; overload systems; scrape; or upload unlawful/abusive content. We may suspend/terminate for violations (see §12).
8) Intellectual Property
The Services, software, content, and marks are owned by FitFinanceDad LLC or its licensors and protected by IP laws. Except for the personal license above, no rights are granted.
9) Feedback
If you submit ideas or suggestions, you grant us a worldwide, royalty-free license to use them without obligation.
10) Changes to the Services or Terms
We may update the Services and these Terms. When material changes occur, we’ll update the “Last Updated” date and, where required, provide additional notice. Continued use means you accept the updates.
11) Third-Party Services & Links
The Services may link to or integrate with third-party products (Plaid, app stores, analytics, cloud infrastructure). Those are governed by their own terms and privacy policies. We are not responsible for third-party services.
12) Termination
You may stop using the Services at any time. We may suspend/terminate access if you violate these Terms, if required by law, or for security/operational reasons. Upon termination, your license ends. Sections that should survive will survive.
13) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL BE CURRENT OR ACCURATE. YOU ARE RESPONSIBLE FOR YOUR FINANCIAL DECISIONS.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITFINANCEDAD LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions don’t allow certain disclaimers or limits; in those places, our liability is limited to the maximum extent permitted.
15) Indemnification
You agree to defend, indemnify, and hold harmless FitFinanceDad LLC and its affiliates, officers, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or violation of another’s rights.
16) Governing Law; Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Laramie County, Wyoming. You waive objections to jurisdiction and venue in those courts.
17) Export & Sanctions
You may not use or export the Services in violation of U.S. export/sanctions laws or other applicable laws.
18) Communications
We may send important notices about the Services or these Terms. Marketing communications will follow your preferences and applicable law; you can opt out where available.

20) Entire Agreement; Severability; Waiver
These Terms and the Privacy Policy are the entire agreement between you and FitFinanceDad LLC for the Services. If any provision is unenforceable, it will be modified to the minimum extent necessary; the rest remains in effect. Our failure to enforce a provision is not a waiver.
Appendix: Open Banking Authorization (Plaid)
By enabling bank linking, you authorize FitFinanceDad LLC to obtain your account information from the institutions you choose through Plaid, solely to provide the Services to you. You agree to Plaid’s End User Services Agreementand Privacy Policy. We do not store your bank credentials. You may revoke access by disconnecting accounts (and via your bank’s security settings, where applicable).
